Terms of Use
This agreement governs the use of the Project map (Service).
By using the Service, you agree to these Terms.
The terminology
The site is an Internet site accessible at https://projectmap.online, through which you can access the "Project map" Service.
Service is a software package that allows the Customer to collaborate with other users registered in the Service.
User - a person to whom the Account Owner or an authorized person has been granted the right to use the Account in the Service.
The account owner is the person who initiated the creation of the Account in the Service.
Authentication data - the data necessary for the user's identification and use of the Service, consisting of the Login-unique identifier, in the form of text, and the Password-a set of characters protecting access to the Customer's Account from third-party access.
Personal data - information that relates to a specific User, which allows to identify this User as a person.
Publicly accessible data - data (including Personal data) to which the individual owner of this data has granted access to an unlimited number of persons (including published on any Internet site without restriction of access to these data) or to which, according to This Agreement and / or current legislation does not apply to the requirement of confidentiality.
Account (account) is a collection of Data of Authorization and Customer Information Materials that are stored and processed in the software and hardware of the Contractor.
Cookie is a piece of data that does not contain any Personal Data created by the Site and stored in the User's computer as one or more files. Blocking a User's Cookie will lead to a difficult use of the Site and Services or to the total inability to use them.
Information materials - any text, graphic, audio, video and mixed information materials.
Tariff plan - a detailed list of options, their characteristics and cost.
1. General Provisions
1.1. Use of the Site is allowed only to the person (User) who has accepted all the terms of this Agreement.
1.2. The User must carefully read the Agreement before using the Site. Using any part of the Site, the User agrees to be bound by the terms of this Agreement with Project map. If you do not agree with the terms of the Agreement (in whole or in part), you are not granted the status and rights of the User and you are prohibited from using the Service, including but not limited to any information posted on the Site and any services provided within the Site.
1.3. The terms of the Agreement apply to all users of the Site - both to users who do not have an account on the Site (unregistered user) or to users who have any account, of any of the available types. An account is a complex of information about a user and authorization data (login, password).
1.4. The User has no right to use the Site and can not accept the terms of the Agreement if he has not reached the statutory age, when he has the right to enter into such agreements.
1.5. If the law of the country of residence or the location of the User prohibits the use of the Site for any reason, the User shall not use the Site, and if he continues to use the Site, he does so at his own risk and under his own responsibility. However, all the terms of this Agreement remain in force.
2. Rights, duties and responsibilities of the parties
2.1. Access to the Site for using the services provided, possible only for the registered User (who created the account).
2.2. If the User considers that the Site contains information that violates his rights, the User is obliged to notify Project map and provide information that confirms this violation of rights. In case the User provides false information about the violation of his rights, he bears full responsibility for the damage caused (including expenses, fees and attorney fees).
2.3. When using the Site, the User is prohibited to:
2.3.1. create more than one free account on the Site;
2.3.2. register an account on behalf of or instead of another person. At the same time, the User is allowed to register as an Administrator within the framework of the relevant Account, as well as the Account of an individual or legal entity, provided by the necessary powers and obtained in the manner and form prescribed by the legislation of USA;
2.3.3. foment and promote incitement to religious, racial or ethnic hatred;
2.3.4. to commit acts that violate the rights, freedom, honor and dignity of a person;
2.3.5. place information (including any materials) infringing copyrights, rights to signs for goods and services, industrial property rights and / or rights to other intellectual property objects owned by Project map and / or third parties;
2.3.6. place information that violates the rights and legitimate interests of third parties (including the placement of photographs and videos, the main object of which is a person, if this person did not consent to the posting on the Site of a photo or video with her/his participation);
2.3.7. place pornographic materials and materials that are prohibited by the legislation on public morality;
2.3.8. to illegally collect, organize, store or distribute personal information of users of other accounts;
2.3.9. try to access the account and / or login and password of another User in any way, including, but not limited to, using deception, abuse of trust, selection of a username and password;
2.3.10. place computer viruses and / or programs capable to interrupt or disrupt the normal functionality of computer equipment and / or software, as well as telecommunications facilities of any persons.
2.4. User Responsibility
2.4.1. The user is solely responsible for any use of information that is on the Site.
2.4.2. The user is solely responsible to third parties for their actions or inaction when using the Site.
2.4.3. The user undertakes to settle independently and at his own expense all claims of third parties that are related to the action or inaction of the User when using the Site.
2.4.4. If the User does not prove the contrary, any actions on the Site carried out using his account and / or his login and password are deemed to be carried out by this User, and the User bears full responsibility for such actions, their consequences and results, if the use of the User account by a third party has been authorized by the User.
2.4.5. If the User places information on the Site that violates agreements between the Parties or current legislation, Project map has the right, without notice, at its own discretion, to block access to this information for the time necessary to establish the legality of the posting and use of such information.
2.4.6. for violation of the terms of this Agreement, Project map has the right to block the User's access to the Site and / or delete the User's account without prior notice.
2.4.7. A user who has the rights to register a new User within his account on the Site confirms that at the time he created the account for the new User, the new User agreed to create such an account and that the new User has read and fully accepted the terms of this Agreement, conditions of "Privacy Agreements" and the terms of other agreements provided on the Site, which are binding for the use of the Site and services. Otherwise, the User bears full and independent responsibility for the actions of the new user when using the Site and the Services.
2.4.8. The user, by providing his account to another person, confirms that at the time of the possibility of such use, the new User has fully accepted the terms of this Agreement, the terms of the "Confidentiality Agreement" and the terms of other agreements provided for on the Site that are mandatory for use when using Site and services. Otherwise, the User who provided access to his account bears full and independent responsibility for the actions of the new user when using the Site and services.
2.4.9. A user who has registered a new user within his account has the right to delete the user's account at any time. The new user does not object to this condition of the Agreement.
2.5. Responsibility of Project map
2.5.1 Project map is not responsible for the use by third parties of information posted by the User on the Site (for example, if the User has authorized third party access to the User's information or if the third party has received unauthorized access), including copying, reproducing and distributing it, implemented both within the Site and in other possible ways.
2.5.2 Project map does not indemnify the damage, direct or indirect, caused to the User or third parties as a result of use or non-use, including the inability to use the Site.
2.5.3 Project map does not undertake any obligation to verify, change and control information that is located by anyone on the Site, does not guarantee and is not responsible for the reliability of the information, its legality, quality and compliance with specific requests and needs of users of the Site.
2.5.4 Project map is not responsible for the content of sites that do not belong to it, links which may be present on the Site, and does not guarantee their availability, correct operation and compliance with the stated subject matter.
3. Intellectual property
3.1. A user who places on the Site any information that contains intellectual property objects, including but not limited, text, graphics, audio and video products, computer programs, databases, signs for goods and services, etc., guarantees that downloading to the Site, copying and using this information and / or objects of intellectual property contained in it, will not violate the rights of third parties.
3.2. This Agreement does not grant the User any property rights to any objects of intellectual property of Project map or third parties, unless explicitly stated, and all property rights in respect of such facilities remain solely with Project map and / or the relevant third party.
4. Confidentiality
4.1. The User confirms that he has read and fully accepted the terms of the "Privacy Agreement" between the User and Project map, which is available at https://projectmap.online/privacy
5. Additional conditions
5.1. Project map has the right to make changes to this Agreement. All changes made to the Agreement will be available in the form of a new version of the Agreement, at https://projectmap.online/user_agreement. In case of significant changes to the Agreement, Project map will notify the User of these changes by e-mail additionally. All amendments to the Agreement come into force from the moment of their publication. Using the services or the Site, the User confirms his consent to the new terms of the Agreement in the release, which is valid at the time the User uses the services or the Site.
5.2. Project map is not responsible for any harm or loss incurred by the User or third parties as a result of misunderstanding of the terms of this Agreement, instructions on how to use the Site, on the procedure for posting information and other technical issues.
5.3. The user provides Project map the right to send messages to the User that contain information about the Site, Project map services and other information. The User agrees that such messages are not considered by the Parties as "spam" (messages, including those of an advertising nature, which the User does not wish to receive).
5.4. If any part of this Agreement is invalid or unenforceable, other parts of the Agreement will remain in force. The refusal by any of the Parties of any provision or provision of this Agreement, or any violation thereof, does not invalidate this provision or condition.
5.5. The site is provided by Project map "as is". Project map does not guarantee the conformity of the Site to the purposes and expectations of the User. Project map is responsible for the uninterrupted and error-free operation of the Site, as well as the safety of the User's account and information posted by the User on the Site, only within the agreements and contracts concluded between the User and Project map
5.6. Project map has the right to unilaterally change the cost, types and terms of the services that are provided within the Site.
5.7. Project map may at any time and without notice to the User assign its rights under this Agreement to a third party.
5.8. To this Agreement and the relationship between Project map and the User, the legislation of USA is applied. Each party fully agrees that the relevant courts of USA have exclusive jurisdiction over any claims and disputes that relate to the Agreement.
